1. About us and these terms
These terms apply to every order placed with us, whether online, by phone or by email. We are Reficio SOS Scotland Limited, trading as Danilo Lucchi, registered in Scotland under company number SC857454, registered office 17 Flowerhill Street, Airdrie ML6 6AP, VAT number GB 498 5295 23. Some parts of these terms apply differently depending on whether you buy as a consumer (for purposes mainly outside your trade, business, craft or profession) or as a business. Where that is the case, we say so.
2. Your order and our contract
When you place an order, we will email you to acknowledge it. A contract is formed when we despatch the goods, or when we email you to confirm acceptance, whichever is earlier. We may decline an order, for example if an item is unexpectedly out of stock or a price was shown in error; if we do, we will refund you in full.
3. Prices and payment
Prices are in pounds sterling. Online prices are shown including VAT at the current rate, with the ex-VAT price also shown for trade customers. Delivery charges are shown before you pay. Online card payments are processed by our payment provider, Dojo, when you place your order. Trade customers with an account may pay on the invoice terms we have agreed with them. If we have made an obvious pricing error, we will contact you before despatch and you may cancel for a full refund.
4. Colours, samples and specifications
Colours on screen are approximations. If colour matching matters, please order a sample before ordering in quantity. Technical specifications are taken from manufacturers' data and may vary within normal manufacturing tolerances. Slight variations in shade can occur between production batches; if you need material from a single batch, tell us when you order.
5. Delivery
We deliver to UK mainland addresses; for other locations, please contact us. Estimated delivery times are shown at checkout or confirmed when you order, and are estimates unless we agree a fixed date in writing. Some items, including aerosols and pressurised canisters, cannot be sent by post or standard courier and are available by phone order or collection only. Risk in the goods passes to you on delivery. Ownership passes to you when we have received payment in full.
Please check your delivery on arrival and tell us within 3 working days of any damage, shortage or wrong item, with photos where possible.
6. Cancelling your order — consumers
If you are a consumer, you have the right to cancel your order within 14 days of the day you receive the goods, without giving a reason. To cancel, tell us clearly by email or phone within that period, quoting your order reference. You must return the goods, unused and in their original condition, within 14 days of telling us you are cancelling; you pay the cost of return unless the goods are faulty or not as described. We will refund the price and our standard delivery charge within 14 days of receiving the goods back (or evidence you have sent them). We may reduce a refund if the goods have been handled more than was necessary to inspect them.
This right does not apply to:
- materials cut to a length you specified, or otherwise made to your specification;
- goods which, after delivery, have been inseparably mixed with other items or used, including opened adhesives and sealants;
- sealed goods unsealed after delivery where they are not suitable for return for health protection or hygiene reasons.
7. Returns — business customers
If you buy as a business, there is no automatic right to cancel. We may accept the return of unused, uncut stock in its original condition by prior written agreement; goods must be returned at your cost, and we will tell you before you return them if a restocking fee applies. Cut lengths and opened adhesives cannot be returned unless faulty.
8. Faulty goods
If goods are faulty, damaged or not as described, contact us as soon as possible at info@danilolucchi.co.uk or on 0141 576 2970, quoting your order reference and including photos where possible. Consumers have legal rights under the Consumer Rights Act 2015, and nothing in these terms affects those rights. We will cover reasonable return costs for faulty or incorrectly supplied goods. For business customers, our liability for faulty goods is limited to repairing, replacing or refunding the goods, at our option.
9. Fitness for purpose and fire performance
It is your responsibility to ensure that the materials you order are suitable for your intended use and meet any regulations that apply to your finished product, including fire safety regulations. Fire test results relate to the material as tested; the performance of a finished item depends on its whole construction, including foams, interliners and adhesives. Where a specification is critical, ask us for the current test certificate before ordering.
10. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. For consumers, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms. For business customers, we are not liable for loss of profit, business, revenue, goodwill or any indirect or consequential loss, and our total liability for any order is limited to the price paid for that order.
11. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control. If such an event affects your order, we will tell you and you may cancel for a full refund of anything not yet delivered.
12. Your information
We use the information you give us to process your order, as explained in our Privacy Policy.
13. Law and jurisdiction
These terms are governed by the law of Scotland and the Scottish courts have jurisdiction. If you are a consumer living in England, Wales or Northern Ireland, you may also bring proceedings in the courts of the part of the UK where you live.
